A proposed rule from the U.S. Department of Housing & Urban Development (HUD) could put tens of thousands of mixed-status families at risk of losing stable housing, including many households with US citizen children.
Under HUD’s current “proration” policy, mixed-status households – families that include both eligible citizens and ineligible members – are allowed to remain in HUD-assisted housing, while ensuring that no subsidy is provided to ineligible individuals.
HUD’s proposed new rule would instead require:

Full citizenship verification for all household members, and

Removal of ineligible members or eviction of the entire household.
If adopted, this rule would effectively force tens of thousands of mixed-status families out of HUD-assisted housing and would place a disproportionate burden on U.S. citizen children, threatening family stability and increasing the risk of homelessness.
In keeping with the League’s policy of speaking with one voice on federal issues, the LWVC Housing & Homelessness Interest Group, together with LWV San Luis Obispo, has filed an action request to LWVUS regarding this proposed HUD rule.
HUD’s public comment deadline is April 21, 2026. While League positions on federal policy are coordinated nationally, individual members are encouraged to submit public comments expressing our concerns.
